1. Agreement to Terms

By accessing or using www.muvs.run and any related services, virtual events, or content (collectively, the “Platform”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, you must stop using the Platform immediately.

If you use the Platform on behalf of a company or organization, you confirm that you are authorized to accept these Terms for that entity and that the entity agrees to comply with them.

2. About MuVS and Our Services

MuVS operates virtual running, cycling, and related fitness events, including registration, result submission, and delivery of medals or other rewards where applicable (“Events”). Services may include user accounts, event pages, payment processing via third‑party providers, and communication through email, social media, or messaging platforms.

MuVS is registered under Dhaka North City Corporation with Trade License No: TRAD/DNCC/003171/2025.

3. Eligibility and Participant Responsibilities

To register for Events, you must:

• Be at least 18 years old, or have parental/guardian consent if you are a minor according to local law.
• Ensure that you are medically fit to participate in physical activities and obtain clearance from a qualified healthcare professional if needed.
• Provide accurate, current, and complete information during registration and when submitting results.

You are solely responsible for:

• Your own health, safety, and training in preparation for Events.
• Choosing suitable routes and environments for virtual activities, including compliance with traffic laws and local regulations.
• Using appropriate and safe equipment (such as properly maintained bicycles, running shoes, helmets, and safety gear).

Participation is voluntary and at your own risk. MuVS does not provide medical advice and does not guarantee any fitness or performance outcomes.

4. Virtual Events and Results

MuVS Events are generally completed remotely at a time and place chosen by you within the specified event window. Event rules, distances, time frames, and reward eligibility will be described on the individual event pages.

You agree that:

• You will record and submit your activity results honestly using accepted tracking methods (e.g., GPS watches, Strava apps).
• MuVS may verify or request supporting evidence of your results and may refuse, adjust, or disqualify entries that appear inaccurate, incomplete, or fraudulent.
• Event formats, dates, and rules may change, and MuVS may cancel or modify an Event if necessary for operational, safety, legal, or other reasons.
• Any rankings, badges, or leaderboards are for entertainment and motivation only and may not reflect official competition standards.

5. User Accounts and Security

To access certain features, you may need to create an account with a username, email, and password. You are responsible for:

• Keeping your login credentials confidential.
• Restricting access to your devices and account.
• Notifying MuVS promptly if you suspect any unauthorized use of your account.

MuVS may suspend or terminate accounts that violate these Terms or that appear compromised, abusive, or fraudulent.

6. Payments, Pricing, and Taxes

Event fees, shipping charges, and any applicable taxes will be shown at checkout before you confirm payment. Payments are processed by third‑party payment providers, and you agree to their terms and policies as well.

By placing an order, you confirm that:

• You are authorized to use the selected payment method.
• You agree to pay all fees and charges in the displayed currency, including any foreign exchange or bank charges that may apply.

MuVS may update prices, introduce new fees, or run promotions at any time, but such changes will not affect orders already completed.

7. Shipping, Delivery, and Risk

For Events that include medals, apparel, or other physical items, MuVS will ship to the address you provide at checkout or in your account profile.

You acknowledge that:

• Delivery times are estimates and may be affected by customs, carriers, or other factors beyond MuVS’s control.
• You are responsible for customs duties, taxes, or import charges that may apply in your country.
• Risk of loss passes to you upon delivery by the carrier, except where otherwise required by applicable law.

If an item is returned due to an incorrect or incomplete address, additional shipping charges may apply for re‑delivery.

8. Refunds, Cancellations, and Changes

MuVS may publish a separate Return and Refund Policy, which forms part of these Terms and applies to all purchases and registrations.

Unless otherwise stated on the Event page or in the Return and Refund Policy:

• Event registrations are generally non‑refundable once confirmed, except where required by law or where MuVS cancels the Event.
• Name transfers, distance changes, or deferrals may be allowed or refused at MuVS’s discretion and may be subject to an administrative fee.
• If MuVS cancels or materially alters an Event, available remedies may include rescheduling, credit toward a future Event, or partial refund, depending on the circumstances.

9. Acceptable Use and Prohibited Activities

You agree not to use the Platform or Events for any unlawful or abusive purpose, including but not limited to:

• Posting or transmitting content that is defamatory, obscene, hateful, violent, or otherwise objectionable.
• Harassing, threatening, or harming other participants, organizers, or third parties.
• Engaging in cheating, result manipulation, or any conduct that undermines the integrity or fairness of Events.
• Infringing the intellectual property or privacy rights of MuVS or any third party.
• Attempting to access the Platform using automated tools, bots, scraping, or other methods that may disrupt or overload services.

MuVS may remove content, suspend participation, or terminate accounts for violations of this section, in addition to any other rights or remedies available under law.

10. Intellectual Property

All content on the Platform, including event concepts, medal designs, logos, text, graphics, photos, and software, is owned by MuVS or used under license and is protected by copyright, trademark, and other intellectual property laws.

Subject to these Terms, MuVS grants you a limited, non‑exclusive, non‑transferable license to access and use the Platform for personal, non‑commercial purposes only. You may not:

• Copy, reproduce, distribute, or create derivative works from the Platform or any content without prior written permission.
• Use MuVS trademarks, names, or branding without express written authorization.

You retain ownership of any original content you post (e.g., photos, stories, or comments), but grant MuVS a worldwide, royalty‑free license to use, display, reproduce, and share such content in connection with Events and marketing, subject to any applicable privacy laws.

11. Third‑Party Services and Links

The Platform may contain links to third‑party websites or services, including payment processors, social networks, and fitness tracking platforms. These sites are not controlled by MuVS, and MuVS is not responsible for their content, policies, or practices.

Your use of third‑party services is governed by their own terms and privacy policies, and you are encouraged to review them carefully.

12. Disclaimers

To the maximum extent permitted by law:

• The Platform and all Events are provided on an “as is” and “as available” basis, without warranties or representations of any kind, whether express or implied.
• MuVS does not guarantee that Events or results will meet your expectations or fitness goals, nor that the Platform will be uninterrupted, secure, or error‑free.
• MuVS makes no medical, health, or performance guarantees and does not replace professional medical advice, diagnosis, or treatment.

You are solely responsible for your participation decisions, and you should stop activity immediately and seek medical attention if you feel unwell or unsafe.

13. Limitation of Liability

To the fullest extent permitted by applicable law, MuVS, its directors, employees, partners, and affiliates shall not be liable for:

• Any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or reputation, arising from your use of the Platform or participation in Events.
• Personal injury, property damage, or death arising from your participation in physical activities related to Events, except where caused directly by MuVS’s proven gross negligence or willful misconduct.

Where liability cannot be excluded, it will be limited to the total amount you have paid to MuVS in the 12 months preceding the claim.

14. Indemnity

You agree to indemnify and hold harmless MuVS and its affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of:

• Your use of the Platform or participation in Events.
• Your breach of these Terms or any applicable law.
• Any third‑party claim related to content you submit or actions you take through the Platform.

15. Privacy and Data Protection

MuVS collects and processes personal data in accordance with its Privacy Policy, which forms part of these Terms and explains how your information is used, stored, and protected. By using the Platform or registering for Events, you consent to such processing, including communication about your registrations and related services.

Depending on your location, you may have certain rights to access, correct, or delete your personal data, which can generally be exercised by contacting MuVS using the details below or as described in the Privacy Policy.

16. Governing Law and Jurisdiction

These Terms and any dispute arising from them or your use of the Platform shall be governed by and construed in accordance with the laws of the People’s Republic of Bangladesh, without regard to conflict of law principles.

You agree that the courts of Dhaka, Bangladesh, shall have exclusive jurisdiction over any dispute or claim relating to these Terms or the Platform, subject to any mandatory legal protections that apply in your place of residence.

17. Changes to Terms

MuVS may update these Terms from time to time, for example to reflect legal, operational, or security changes. When changes are made, the “Last updated” date will be revised, and updated Terms will be posted on www.muvs.run.

Continued use of the Platform or participation in Events after changes take effect constitutes your acceptance of the updated Terms.
